General terms and conditions of sale
ARTICLE 1- PURPOSE - SCOPE OF APPLICATION
The present general conditions of sale and services have for object to govern the sales concluded at distance by the company SAS Starlight with the Internet users by the means of Internet site eu.airton.shop
The fact that the Buyer places an order on the Site implies his unreserved acceptance of and adherence to these General Terms and Conditions of Sale and Service. In this respect, the Buyer declares that he/she has read and accepted the General Terms and Conditions of Sale before placing his/her order.
The sales offers proposed by AIRTON are exclusively intended for customers with the capacity to contract, and are only relevant to the territory of metropolitan France and the EU.
ARTICLE 2 - THE ORDER
To place an order on the Site, the Buyer must comply with the instructions given on the Site.
How to order?
The Buyer must fill in the order form, ensuring that the necessary information is complete and accurate.
The ordering procedure is as follows:
The Buyer selects the products or services by clicking on the "add to cart" button corresponding to the desired product.
As soon as a product is added to the basket, the Buyer is invited to continue shopping or to click on "Place Order" in order to go to his/her basket.
By clicking on the "MY CART" tab, the buyer can enter the quantities of the products he/she wishes to order already added to the basket.
From the shopping cart, the buyer clicks on "GO TO PAYMENT", he is then invited to connect to an existing account, create an account or order without creating an account. Depending on the option chosen, the buyer is then invited to enter their delivery and billing details or to check the existing details.
In order to proceed with the order, the buyer clicks on the "Proceed to payment" button, he/she is then invited to check the delivery method and to accept the present general sales conditions. Once accepted, he/she clicks again on the button "Proceed to payment".
A summary of the order is then submitted to the Buyer. The Buyer can then check and modify all or part of his/her order or click on the "Continue Shopping" function to add new products or services.
The Buyer validates - definitively - the content and the amount of the order. The validation - which is equivalent to the Buyer's express acceptance - is materialised by clicking on the "Pay" button, or by selecting another means of payment.
ARTICLE 3 - VALIDATION AND PAYMENT OF THE ORDER
Prices are payable exclusively in euros (€).
The Buyer shall proceed to the immediate payment of his order according to the terms and conditions specified below.
On receipt of full payment for the order, AIRTON will proceed to validate the order.
AIRTON reserves the right not to follow up on the order placed by the Buyer if it is impossible to use the Buyer's means of payment and in the event of a legitimate reason within the meaning of Article L.122-1 of the Consumer Code.
AIRTON will then inform the Buyer of the refusal of his order.
Online payment of the order
The Buyer enters his bank details on the Site during the ordering process.
A secure online payment system is implemented by AIRTON. Thus, all bank data is encrypted so that the information communicated is protected during its transmission.
Refusal of authorisation by the banking centre shall automatically lead to the cancellation of the Buyer's order.
The Buyer's order is validated by AIRTON as soon asAIRTON 's banking partner accepts the Buyer's payment method.
The Buyer guarantees the Seller that he is entitled to use the method of payment used for the payment of his order and in particular has the necessary authorisations to use this method of payment when validating the order.
If an incident occurs during the registration of the Buyer's order, the order will be null and void and the Buyer will have to repeat the ordering procedure
ARTICLE 4 - PRODUCTS AND SERVICES
Characteristics of the products and services The Buyer is informed on the Site of the essential characteristics of the products and services.
The Buyer is invited to take note of the instructions for use or any other information attached to the product or carried on the product or its packaging (precautions for use, conditions of use)
AIRTON informs the buyer that the commissioning of its air conditioners Airton can be carried out by the buyer himself, provided that he uses the ReadyClim system. Otherwise, the buyer must pay for the service of a certified refrigeration professional with a certificate of competence.
The use of the products shall be carried out under the sole responsibility of the Buyer. Under these conditions, the Buyer is required to maintain the product in good condition and to use it in accordance with its intended purpose.
AIRTON shall in no event be liable for any defects or deterioration of the products delivered resulting from abnormal or improper use after delivery of the products.
Availability
The offers ofAIRTON are subject to availability and, where applicable, to the time limits indicated.
The products displayed as available may no longer be available at the time the Buyer places the order. Consequently, the sale is only concluded after AIRTON has validated the order placed by the Buyer with regard to the availability of the products ordered.
In the event of total or partial unavailability of an ordered product, the Buyer will have the possibility of cancelling the entire order, free of charge, or of confirming the order for the available items ordered.
ARTICLE 5 - PRICES
The prices displayed on the Site are indicated in euros (€), all taxes included (T.T.C.) and excluding shipping costs.
The total cost of the order, including the total price of the order including VAT at the rate effectively applicable, as well as the delivery costs, will be communicated to the Buyer before the final validation of the order.
The taxes applicable to the order and in particular VAT are those in force on the day the order is placed.
ARTICLE 6 - SHIPPING COSTS
Some orders give rise to the invoicing of a contribution to shipping costs. The shipping costs for AIRTON products are the same for the whole of metropolitan France (excluding Corsica). Additional charges may apply within Europe.
For deliveries of accessories and spare parts, special rates may apply in metropolitan France and the European Union.
ARTICLE 7 - DELIVERY OF PRODUCTS
The products ordered are delivered to the place of delivery mentioned on the order. The order may be delivered in several packages at the discretion of AIRTON, without this resulting in additional costs for the Buyer.
It is specified that the Buyer has the possibility to indicate a delivery address different from the billing address.
Deliveries are made in continental France and in the European Union
To ensure that your delivery goes smoothly, here are some tips:
Count your parcels and check the external condition of the packaging.Fill in your delivery note yourself, which the deliverymen will have you sign.Note your name, the time and date of delivery, and sign your delivery note, taking care to tick the boxes on the note.If a parcel is damaged and/or missing, please note the reference on the delivery note and specify whether the parcel is refused and/or accepted.
Please note that no claim can be accepted without the application of these procedures.
We remind you that the mention "subject to unpacking" has no value.
ARTICLE 8 - DELIVERY TIMES
Delivery times run from the moment the order is validated by AIRTON , which undertakes to deliver the products ordered as quickly as possible.
AIRTON undertakes to use all necessary means to respect the delivery times indicated at the time of validation of the order.
In any case, delivery within the specified period can only take place if the Buyer has fulfilled all his obligations towardsAIRTON.
The Buyer undertakes to provide AIRTON with a valid delivery address and accurate contact details.
In the event of inaccurate or erroneous information, AIRTON cannot be held responsible for the impossibility of delivery.
The delivery does not include the commissioning of the devices.
If the parcel is returned to AIRTON for an incomplete address, AIRTON undertakes to contact the Buyer to inform him/her of the situation and to request additional information on the address or the new shipping address. The costs of this new shipment as well as the return costs related to it, previously communicated to the Buyer by AIRTON will be charged to the Buyer.
ARTICLE 9 - CONFORMITY OF PRODUCTS
Upon receipt of the goods, the buyer must check the package and verify the contents in the presence of the delivery person, before signing the delivery note.
If the products delivered have suffered damage and are deteriorated, the buyer must refuse the package by writing the reason for refusal on the delivery slip. In the absence of reservations on the delivery slip, the goods will be considered as delivered in conformity.
As soon as the delivery note is signed, without any precise reservation, the responsibilities of the carrier and of AIRTON will be released for any damage caused during the delivery operations, with the exception of the legal guarantees.
ARTICLE 10 - PROVISION OF SERVICES
The services offered by AIRTON on an ancillary basis cover the installation of products and commissioning.
The premium guarantee
The commercial guarantee (premium) offered by Airton does not replace the legal guarantee of conformity. You can subscribe to this warranty when you purchase your air conditioner or within 30 days of purchase.

ARTICLE 11 - FORCE MAJEURE
AIRTON shall not be held responsible for the non-performance of all or part of its obligations due to the occurrence of an event of force majeure.
Thus, in the event of a fortuitous event or a case of force majeure that hinders or delays the performance of the obligations of AIRTON in whole or in part, the performance of these obligations by AIRTON shall be suspended.
This includes, but is not limited to, natural disasters, bad weather, wars, attacks or any other similar events.
And more generally, any events beyond the control of AIRTON, which in good faith prevent AIRTON from fulfilling its obligations.
ARTICLE 12 - RIGHT OF WITHDRAWAL
In accordance with the provisions of article L.121-21 et seq. of the French Consumer Code, the Buyer has a fourteen (14) day cooling-off period to cancel his/her order, without having to give reasons for his/her decision.
The fourteen (14) day withdrawal period runs from the day the Buyer receives the product.
In the case of an order for several products delivered separately, the withdrawal period expires fourteen (14) days after the Buyer takes physical possession of the last product.
In order to exercise this right of withdrawal, the Buyer must notify AIRTON of his/her decision to withdraw before the expiry of the period indicated above, giving the order number and his/her full contact details.
After verification by AIRTON, the Buyer receives an e-mail confirming the registration of the exercise of his right of withdrawal.
In accordance with Article L.121-21-8 of the French Consumer Code, the Buyer may not exercise his right of withdrawal: In the case of the sale of personalised products, made to the Buyer's specifications.
Effects of withdrawal
The Buyer must return the products to the address indicated by AIRTON when confirming the registration of the decision to withdraw, recalling the order number and full contact details and accompanied by the duly completed return form, without undue delay and, at the latest, within fourteen (14) days following the communication of his decision.
The direct costs of returning the products as well as the risks of return remain at the Buyer's expense.
The products must be returned in their original packaging, in their original condition, in perfect condition, neither opened nor unpacked, accompanied by all accessories and instructions and accompanied by their invoice.
The Buyer shall be liable for any depreciation of the products resulting from handling other than that necessary to establish the nature of the products' proper functioning.
In the event of a request for reimbursement, AIRTON will reimburse the Buyer for all sums paid by the Buyer corresponding to the sale price of the returned product minus the return costs.
However, AIRTON will not reimburse the Buyer for the price of products opened, returned incomplete or damaged by the Buyer. These products will be reshipped to the Buyer at his/her expense.
Refusal to deliver
In the case of a refusal of delivery during the legal 14-day withdrawal period, and in the case of a request for reimbursement by the buyer, transport costs at a rate of 60€ including VAT will be automatically deducted from the total amount of the order (excluding chronopost).
For orders of accessories (except air conditioners), an amount of 14,99€ will be automatically deducted from the total amount of the order
This fee is equivalent to a contribution to the costs incurred by AIRTON for the non-delivery and repatriation of the goods.
The refund will be made after receipt and verification of the products by AIRTON.
AIRTON make the refund using the same payment method as the one used by the Buyer for the initial transaction
